Terms and Conditions for
Capture a Perfect Memory

TERMS AND CONDITIONS OF BOOKING

RETAINER AND REFUND

A non-refundable retainer in the amount of $99 is required at the time of signing this agreement. Acceptable forms of payment are cash, checks, Venmo, major credit cards, and PayPal. The retainer secures the event date and times for the client and is non-refundable. We understand plans change and there may be times you need to cancel an event. When cancellation is received in writing over 14 days prior to your event start time, the refund will process, minus the $99 non-refundable retainer. Cancellations made less than 14 days prior to the event start time will not receive any amount refunded. 

BALANCE DUE

Photo booth services will not begin until the client pays the balance in full. The remaining balance is due 7 days prior to the event start time. If the client cannot make the remaining payment within 7 days of the client's event date, Capture a Perfect Memory shall end this contract under no further obligation, keep any money already paid, and not attend the event. Client must pay payment for any overage in time before we provide additional hours.

 

RETURNED CHECKS

Client will pay a $50.00 fee for all returned checks.

 

TRAVEL FEE

We do not charge a travel fee within 35 miles of Madison, Al 35756. We charge any events further than 35 miles, a travel fee of $0.60 per additional mile, and are subject to approval.

PHOTO BOOTH OPERATIONS

Capture a Perfect Memory shall have the photo booth operational for the time specified; however, in some situations, operations may need to be interrupted for maintenance, service and/or photography optimizations. Capture a Perfect Memory agrees to send a qualified attendant to maintain and operate the photo booth for the full duration of the agreed time.

 

PHOTO LAYOUTS

Customer should provide a draft of required photo layout not later than 7 days before the date of the event. A maximum of 3 versions (1st proposal and 2 revisions) per photo layout will be sent to the customer for approval. No requests for revisions will be considered 2 working days prior to the event. We print photos in standard 2x6 inches or 4x6 inches unless otherwise agreed. Capture a Perfect Memory logo will be included on all pictures (whether printed or on electronic copies)

 

PRINTING

Capture a Perfect Memory agrees to provide client unlimited prints at the event.

 

PHOTO BOOTH SETUP/TAKEDOWN

Capture a Perfect Memory will deliver, set up, and remove the photo booth from the event location. Capture a Perfect Memory requires access to the venue at least 90 minutes before the event and 60 minutes after the event for setup and takedown. 

 

SPACE & PLACEMENT REQUIREMENTS

Client will arrange for an appropriate space for the photo booth at the designated venue (10’ deep x 10’ wide x 10’ high). Client provides a power source for the photo booth (110V, 10 amps, 3 prong outlet).

 

OUTDOOR EVENTS

If the venue is to be held outdoors client understands we can shut the photo booth down during the event because of inclement weather (wind, rain, snow or hail). If there is inclement weather and the photo booth has to be shut down, the event will be cancelled and any monies given are non-refundable. We suggest the client has a contingency plan in place for outdoor events to prevent a possible shut down because of inclement weather. A contingency plan can be to have indoor space available at the time of the event so we can move the event indoors prior to setting up. Or the client can have a protective tent covering at the event. Capture a Perfect Memory will only set up and takedown equipment one time, so please plan accordingly.

LIABILITY AND INDEMNIFICATION

Client agrees to, and understands: 1) Client will indemnify provide against all liability related to client’s event during or after client's event unless arising from negligence or willful misconduct of Capture a Perfect Memory. 2) Client will indemnify Capture a Perfect Memory against all liability associated with the use of pictures taken within Capture a Perfect Memory’s photo booth, it’s representatives, employees or affiliates at the client’s event, provided that any use by Capture a Perfect Memory is under the initiated terms of agreement. 3) Clients will assume all legal fees claimed by third persons, loss of profits or increased expenses, provided that the fault or negligence of Capture a Perfect Memory or its employees, agents, or subcontractors did not cause such loss or damage. 

 

DAMAGE TO CAPTURE A PERFECT MEMORY'S EQUIPMENT

Client acknowledges it shall be responsible for any damage or loss to the equipment owned by Capture a Perfect Memory caused by: a) any misuse of the equipment by the client or its guests, or b) any theft.

MODEL RELEASE (We will exclude this release upon request) 

All guests using the photo booth give to Capture a Perfect Memory: The right and permission to copyright and use, photographic portraits or pictures of any photo booth user who may be included intact or in part, made through all media now or known for illustration, art, promotion, advertising, trade, or any other purpose.
