Capture a Perfect Memory
TERMS AND CONDITIONS OF BOOKING
RETAINER AND REFUND
A non-refundable retainer in the amount of $99 is required at the time of booking to secure the event date. Accepted forms of payment are cash, check, Venmo, major credit cards, and PayPal. The remaining balance must be paid prior to the event start time and is non-refundable.
Cancellation requests must be submitted at least 14 days prior to the event date. If cancellation is received within this timeframe, the retainer will be forfeited but no additional charges will apply. Cancellations made less than 14 days prior to the event date will not receive any refund.
BALANCE DUE
Photo booth services will not begin until the balance is paid in full. If full payment is not received prior to the event start time, Capture a Perfect Memory reserves the right to cancel services without refund and without further obligation.
RETURNED CHECKS
Client will pay a $50.00 fee for all returned checks.
TRAVEL FEE
We do not charge a travel fee for events within 35 miles of Madison, AL 35756. Events located beyond 35 miles will incur a travel fee of $0.60 per additional mile and are subject to approval.
PHOTO BOOTH OPERATIONS
Capture a Perfect Memory shall have the photo booth operational for the time specified; however, in some situations, operations may need to be interrupted for maintenance, service and/or photography optimizations. Capture a Perfect Memory agrees to send a qualified attendant to maintain and operate the photo booth for the full duration of the agreed time.
OVERTIME
Overtime must be requested and approved prior to the end of the scheduled event time and is subject to staff availability. Additional charges will apply.
PHOTO LAYOUTS
Customer should provide a draft of required photo layout no later than 7 days before the date of the event. A maximum of 3 versions (1st proposal and 2 revisions) per photo layout will be sent to the customer for approval. No requests for revisions will be considered 2 working days prior to the event. We print photos in standard 2x6 inches or 4x6 inches unless otherwise agreed.
PRINTING
Capture a Perfect Memory agrees to provide unlimited prints during the event, subject to normal operation of equipment and availability of supplies.
PHOTO BOOTH SETUP/TAKEDOWN
Capture a Perfect Memory requires access to the venue at least 60 minutes prior to the event start time for setup and testing. Breakdown will begin promptly at the end of the event.
SPACE & PLACEMENT REQUIREMENTS
Client will arrange for an appropriate space for the photo booth at the designated venue (10’ deep x 10’ wide x 8’ high). Client provides a power source for the photo booth (110V, 3 prong outlet).
VENUE RESTRICTIONS/ ACCESS
Client is responsible for confirming venue rules, space requirements, and power access. Capture a Perfect Memory is not responsible for limitations imposed by the venue that affect service.
OUTDOOR EVENTS
If the event is held outdoors, client understands we can shut the photo booth down during the event if weather conditions are unsafe or may cause damage to equipment. In the event the booth must be shut down, no refunds will be issued. We suggest the client have a contingency plan for outdoor events to prevent possible shutdown due to inclement weather.
LIABILITY AND INDEMNIFICATION
Client agrees to indemnify and hold harmless Capture a Perfect Memory, its employees, agents, and affiliates from any liability, claims, damages, or costs arising from injury or property damage during the use of any photo booth equipment, including but not limited to the overhead 360 booth. Capture a Perfect Memory shall not be held liable for any injuries, damages, or losses resulting from misuse of the equipment, failure to follow staff instructions, or unsafe behavior by guests. Client acknowledges that use of the 360 booth involves movement and agrees to assume all associated risks. Client is responsible for ensuring guests follow all safety instructions provided by booth attendants. Capture a Perfect Memory reserves the right to stop use of the booth at any time if unsafe conditions arise.
ALCOHOL/ ADULT EVENTS
Capture a Perfect Memory reserves the right to limit participation of any guest who appears overly intoxicated for safety reasons.
FORCE MAJEURE
Capture a Perfect Memory is not liable for failure to perform due to events beyond our control, including but not limited to power outages, venue restrictions, weather conditions, or emergencies.
EQUIPMENT RESPONSIBILITY
Client is responsible for any damage to equipment caused by guests. Repair or replacement costs will be billed to the client.
MODEL RELEASE (We will exclude this release upon request)
All guests using the photo booth agree to allow Capture a Perfect Memory to use photos for marketing, advertising, and promotional purposes unless otherwise requested in writing.
